General Terms of Service and Delivery

1. General

These general terms of service and delivery (hereinafter referred to as “Terms”) for the Disc Times disc golf course booking and payment system and ProShop (hereinafter referred to as “Service”) include the terms of use for consumer customers of the service provided by Premium Disc Golf Oy (hereinafter referred to as “PDG” or “Service Provider”) and third-party partners (hereinafter referred to as “Partners”).

2. Applicable Terms

These Terms apply to all Services purchased from the Service Provider. A contract in accordance with the applicable terms is formed when the Service Provider confirms the booking or purchase.

4. Changes

The Service Provider reserves the right to make changes to the Service. The Service Provider has the right to unilaterally change these terms, the content, or the selection of the service. Changes will take effect thirty (30) days after notifying the user of such changes.

5. Registration

By registering for the Service or purchasing products and services from the Service, you accept these terms and agree to comply with them.

Registration occurs by providing your phone number during the first login. Only natural persons can register, and registration is free of charge.

PDG may refuse registration if the user has violated these terms or acted against the law or good conduct.

We process the personal data you provide during registration for the purpose of selling Partners’ products and services.

6. User Responsibilities and Obligations

The user is responsible for complying with these terms when using the Service.

The user agrees to use the Service only for purposes in accordance with the law and good conduct.

The user agrees not to send or transmit material in the Service that is against the law and good conduct, incites such action, or promotes it.

The user is responsible for obtaining and maintaining all equipment, software, and data connections required for the use of the Service, as well as other costs arising from the use of the service.

The user is fully responsible for any damage caused to the Service Provider, other users, and third parties due to the use of the Service contrary to these terms, the law, or good conduct.

7. Intellectual Property Rights

The Service contains material protected by copyright, trademark rights, and other intellectual property rights. The Service as a whole is protected by copyright under Finnish copyright law. The user may use the Service only for the agreed purpose; images, links, or other materials may not be copied or attached to other products without the express prior written consent of the Service Provider.

We reserve all rights to the Service and its content. The user does not have the right to copy, reproduce, store, transfer, retransmit, distribute, publish, attach to other material, or download any material related to the Service (including text, images, trademarks, logos, graphics, or music) onto their computer by any means without the express prior written consent of the Service Provider. The user may browse the site and use the Service only for personal use. The use of trademarks and business identifiers related to the Service is prohibited unless expressly stated otherwise in these terms or with the express prior written consent of the Service Provider.

Violation of this section may result in liability for damages and/or criminal liability. Violation of these terms may result in the termination of the right to use the Service.

The Service Provider has the right to remove a reservation made in the Service if the user has not provided correct information about themselves or if the user violates these terms.

8. Purchasing Products and Services

Booking a Round

Rounds are booked through the application for the desired course. A registered user can book a round for either a paid or a free course. On a paid course, the user can book a round for themselves and add other users to the round. On a paid course, the user pays for all the rounds they add to the booking.

Support Fee

A free course may have a support fee. The support fee is a voluntary payment that allows the user to support the course in the form of a voluntary recreational facility fee.

ProShop

In the ProShop online store, Service Partners can sell their desired products. Each Partner selling products in the ProShop is responsible for the marketing of the products and the accuracy of the information provided.

Value-Added Tax

The price of the service or product shown in the Service may include the applicable value-added tax based on the Partner’s VAT liability. If the Partner offering the products and services is registered as VAT liable, the displayed price includes VAT; if the Partner is not registered as VAT liable, the displayed price does not include VAT.

Transaction Fee

In addition to the price displayed in the Service, we charge a transaction fee. The transaction fee always includes the applicable value-added tax.

9. Delivery Methods and Terms

The booking of a round is visible in the Service when the user is logged in. The Partner selling the product is responsible for the delivery of products purchased from the ProShop.

10. Payment Terms

A third-party payment platform (credit card payments, MobilePay, Google Pay, Apple Pay) is used for payment transactions, and the Service Provider is not responsible for any potential disruptions.

Payment Service Provider

The payment intermediary service and payment service provider is Stripe https://stripe.com/en-fi.

Stripe appears as the recipient of the payment on the account statement or card invoice and forwards the payment to the Service Provider.

Credit Card Payments

You can pay in the online store with Visa, Visa Debit, Visa Electron, MasterCard, Debit MasterCard, and American Express cards. The online store uses the international Verified by Visa, MasterCard SecureCode, and American Express SafeKey authentication services. Premium Disc Golf Oy appears as the recipient of the payment on the account statement or card invoice and forwards the payment to the merchant. Credit card payments are made securely on a protected payment form, and credit card information is not stored in the online store systems. Credit cards can be used via Google Pay and Apple Pay.

Mobile Payment Methods

Mobile payment methods (MobilePay) are services that work in the application and allow you to pay for online purchases via bank transfer from your account or card payment from your card by accepting the payment in the respective application. MobilePay payment terms are available on MobilePay’s website.

11. Cancellations

Partners are responsible for the cancellation of their services, incorrect marketing, availability, reliability, and accuracy, and any liability for damages arising from these.

12. Cancellation of a Round

The user can cancel their participation in a round through the application. On a paid course, when canceling a round, the user receives a round ticket which can be used to book a new round for free. No money is refunded for a canceled round. If the user has paid for multiple participants’ rounds, a round ticket is returned for all rounds paid by the user.

Palvelun yleiset käyttö- ja toimitusehdot  

1. Yleistä

Nämä Disc Times frisbeegolfratojen varaus- ja maksujärjestelmän sekä ProShop-kaupan yleiset käyttö- ja toimitusehdot (jäljempänä Ehdot) sisältävät Premium Disc Golf Oy:n (jäljempänä ”PDG” tai ”Palveluntarjoaja”) ja kolmannen osapuolen kumppaneiden (jäljempänä ”Kumppanit”) tarjoaman palvelun (jäljempänä Palvelu) käyttöä koskevat ehdot kuluttaja-asiakkaille. 

2. Sovellettavat sopimusehdot

Näitä Ehtoja sovelletaan kaikkiin Palvelutarjoajalta ostettuihin Palveluihin. Sovellettavien ehtojen mukainen sopimus syntyy, kun Palveluntarjoaja vahvistaa varauksen tai ostoksen.

4. Muutokset

Palveluntarjoajalla on oikeus tehdä muutoksia Palveluun. Palveluntarjoajalla on oikeus muuttaa yksipuolisesti näitä ehtoja, palvelun sisältöä tai valikoimaa. Muutokset tulevat voimaan kolmenkymmenen (30) päivän kuluessa siitä, kun ilmoitamme tällaisista muutoksista käyttäjälle.

5. Rekisteröityminen

Rekisteröityessäsi Palveluun tai ostamalla tuotteita ja palveluita Palvelusta hyväksyt nämä ehdot ja sitoudut noudattamaan näitä ehtoja.

Rekisteröinti tapahtuu antaessasi puhelinnumerosi ensimmäisen sisäänkirjautumisen yhteydessä. Rekisteröityä voi ainoastaan luonnollinen henkilö ja rekisteröityminen on maksutonta. 

PDG voi evätä rekisteröitymisen, mikäli käyttäjä on rikkonut näitä ehtoja tai toiminut lain tai hyvän tavan vastaisesti.

Käsittelemme rekisteröitymisesi yhteydessä antamasi henkilötietoja Kumppaneiden tuotteiden ja palveluiden myymistä varten.

6. Käyttäjän vastuut ja velvollisuudet

  • Käyttäjä vastaa siitä, että hän noudattaa näitä ehtoja Palvelua käyttäessään.
  • Käyttäjä sitoutuu käyttämään Palvelua vain lain ja hyvän tavan mukaisiin tarkoituksiin.
  • Käyttäjä sitoutuu olemaan lähettämättä tai välittämättä Palvelussa materiaalia, joka on lain ja hyvän tavan vastaista, yllyttää tällaiseen toimintaan tai edistää sitä.
  • Käyttäjä vastaa kaikista hänelle Palvelun käytön edellyttämän laitteiston, ohjelmiston ja tietoliikenneyhteyksien hankinnasta ja ylläpidosta sekä muista palvelun käytöstä aiheutuvista kustannuksista.
  • Käyttäjä vastaa täysmääräisesti näiden ehtojen, lain tai hyvän tavan vastaisesta Palvelun käytöstä aiheuttamastaan vahingosta Palveluntarjoajalle, muille käyttäjille ja kolmansille osapuolille.

7. Aineettomat oikeudet eli immateriaalioikeudet

Palvelu sisältää tekijänoikeudella, tavaramerkkioikeudella ja muilla immateriaalioikeuksilla suojattua materiaalia. Palvelu sellaisenaan on suojattu tekijänoikeudella Suomessa voimassa olevan tekijänoikeuslain mukaan. Käyttäjä saa käyttää Palvelua vain sovittuun tarkoitukseen; kuvia, linkkejä tai muuta aineistoa ei saa kopioida tai liittää muuhun tuotteeseen ilman Palveluntarjoajan nimenomaista etukäteistä kirjallista suostumusta.

Pidätämme kaikki oikeudet Palveluun ja sen sisältöön. Palvelun käyttäjällä ei ole oikeutta osaksikaan kopioida, muutoin jäljentää, tallentaa, siirtää, edelleen lähettää, jaella, julkaista, liittää toiseen materiaaliin tai ladata omalle tietokoneelleen millään keinolla mitään Palveluun liittyvää materiaalia (mukaan lukien teksti, kuvat, tavaramerkit, logot, grafiikka tai musiikki) ilman Palveluntarjoajan nimenomaista etukäteistä kirjallista suostumusta. Käyttäjä voi selata sivustoa ja käyttää Palvelua vain henkilökohtaiseen käyttöön. Palveluun liittyvien tavara- ja tuotemerkkien sekä yritys- ja liiketunnusten käyttäminen on kielletty, ellei näissä ehdoissa ole erikseen nimenomaisesti toisin mainittu tai ellei Palveluntarjoaja ole antanut käyttöön nimenomaista etukäteistä kirjallista lupaa.

Tämän kohdan vastainen menettely voi johtaa vahingonkorvaus- ja/tai rikosoikeudelliseen vastuuseen. Näiden ehtojen rikkomisesta voi seurata Palvelun käyttöoikeuksien lakkaaminen.

Palveluntarjoajalla on oikeus poistaa Palvelussa tehty varaus, jos käyttäjä ei ole antanut oikeita tietoja itsestään tai jos käyttäjä rikkoo näitä ehtoja.

8. Tuotteiden ja palveluiden ostaminen

Lähdön varaus

Lähdöt varataan sovelluksen kautta halutulle kentälle. Rekisteröitynyt käyttäjä voi varata lähdön joko maksulliselle tai maksuttomalle kentälle. Maksulliselle kentälle käyttäjä voi varata lähdön itselleen sekä lisätä lähtöön muita käyttäjiä. Maksullisella kentällä käyttäjä maksaa kaikki lähtöön lisäämänsä käyttäjien lähdöt.

Tukimaksu

Maksuttomalla kentällä voi olla käytössä tukimaksu. Tukimaksu on käyttäjälle vapaaehtoinen maksu liikuntapaikkamaksu, jonka maksamalla käyttäjä voi tukea kyseistä rataa vapaaehtoisen liikuntapaikkamaksun muodossa.

ProShop

ProShop verkkokaupassa Palvelun Kumppanit voivat myydä haluamiaan tuotteita. Jokainen ProShop-kaupassa tuotteita myyvä Kumppani vastaa myytävien tuotteiden markkinoinnista ja antamiensa tietojen oikeellisuudesta.

Arvonlisävero

Palvelussa esitetty palvelun tai tuotteen hinta voi sisältää kulloinkin voimassa olevan arvonlisäveron perustuen Kumppanin arvonlisäverovellisuuteen. Mikäli tuotteita ja palveluita tarjoava Kumppani on rekisteröity arvonlisäverovelvolliseksi, sisältää esitetty hinta arvonlisäveron, mikäli Kumppani ei ole rekisteröity arvonlisäverovelvolliseksi, ei esitetty hinta sisällä arvonlisäveroa.

Tapahtumamaksu

Palvelussa esitetyn hinnan lisäksi perimme tapahtumamaksun. Tapahtumamaksu sisältää aina voimassa olevan arvonlisäveron.

9. Toimitustavat ja -ehdot

Lähdön varaus näkyy Palvelussa kun käyttäjä on kirjautunut sisään. ProShop-kaupasta ostettujen tuotteiden toimituksesta vastaa kyseistä tuotetta myyvä Kumppani.

10. Maksuehdot

Maksutapahtuman yhteydessä käytetään kolmansien osapuolten maksualustaa (maksukorttimaksut, MobilePay, Google Pay, Apple Pay), eikä palveluntarjoaja ole vastuussa näiden mahdollisista häiriöistä.

Maksupalvelutarjoaja

Maksunvälityspalvelun toteuttajana ja maksupalveluntarjoajana toimii Stripe https://stripe.com/en-fi. 

Stripe näkyy maksun saajana tiliotteella tai korttilaskulla ja välittää maksun Palveluntarjoajalle. 

Luottokorttimaksut

Voit maksaa verkkokaupassa Visa-, Visa Debit-, Visa Electron-, MasterCard-, Debit MasterCard – ja American Express -korteilla. Verkkokaupassa ovat käytössä kansainväliset Verified by Visa -, MasterCard SecureCode – ja American Express SafeKey -todentamispalvelut. Premium Disc Golf Oy näkyy maksun saajana tiliotteella tai korttilaskulla ja välittää maksun kauppiaalle. Korttimaksaminen tapahtuu turvallisesti suojatulla maksulomakkeella, eikä maksukortin tietoja tallenneta verkkokaupan järjestelmiin. Maksukortteja voi käyttää Google Pay:n ja Apple Pay:n kautta.

Mobiilimaksutavat

Mobiilimaksutavat (MobilePay) ovat sovelluksessa toimivia palveluita, joilla voi maksaa verkko-ostoksia tilisiirtona tililtään tai korttimaksuna kortiltaan hyväksymällä maksun kyseisessä sovelluksessa. Mobile Pay maksuehdot ovat saatavilla MobilePayn verkkosivuilla.

11. Peruutukset

Kumppanit vastaavat omien palveluidensa peruuntumisesta, virheellisestä markkinoinnista, saatavuudesta, luotettavuudesta ja virheettömyydestä sekä näihin liittyvästä mahdollisesti syntyvästä vahingonkorvausvelvollisuudesta.

12. Lähdön peruuttaminen 

Käyttäjä voi perua osallistumisensa lähtöön sovelluksesta. Maksullisella kentällä peruessaan lähdön, käyttäjä saa lähtölipun jota käyttämällä voi varata uuden lähdön maksuttomasti. Perutusta lähdöstä ei palauteta rahaa. Mikäli käyttäjä on maksanut useamman osallistujan lähdöt, palautetaan kaikista käyttäjän maksamista lähdöistä lähtölippu.
